Refunds

Refunds are given to users where the service provided is either disrupted or poor. The quality of service will be judged objectively by Invision-Gaming and refunds will only be given up to 7 days after the purchase of your order.

Refunds can be given after this time if requested by a user and we agree that a refund is best suited for the current situation.

A consumer will only be entitled to a refund where they are legally entitled to one by the Sale of Goods Act 1979 and unless we believe you should be awarded a refund or there are strong reasons for your refund request you will not be entitled to a refund. For example, 'if your clan disbands and you no longer require a game server' this is not reasons for a refund.

If a refund is requested without substantiated evidence that the requested refund is a result of a poor quality service and we are in disagreement, you will be granted a refund at the discretion of Invision Gaming sales support and any refunds may hold a surcharge to cover administration costs. In addition any fees we have incurred while providing your service, such as support time, server modification additions (such as third party mods that require rent, including but not limited to HLStatsX Premium) or any other expenditure made by Invision Gaming may also be added.

We are always willing to provide a remedy for any problems you may have had while at Invision Gaming and you should try to email support first.

In these Terms and Conditions “we, our, us, Invision Gaming” refers to Invision Gaming.

ACCEPTANCE OF TERMS

By accessing the content of www.invision-gaming.co.uk (“the Website”) you agree to be bound by the terms and conditions set out herein and you accept our privacy policy available at www.invision-gaming.co.uk/privacy.php If you object to any of the terms and conditions set out in this agreement you should not use any of the products or services on the Website and leave immediately. You agree that you shall not use the Website for illegal purposes, and will respect all applicable laws and regulations. You agree not to use the website in a way that may impair the performance, corrupt the content or otherwise reduce the overall functionality of the Website. You also agree not to compromise the security of the Website or attempt to gain access to secured areas or sensitive information. You agree to be fully responsible for any claim, expense, liability, losses, costs including legal fees incurred by us arising from any infringement of the terms and conditions set out in this agreement.

MODIFICATION

Invision Gaming reserve the right to change any part of this agreement without notice and your use of the Website will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement. Invision Gaming have complete discretion to modify or remove any part of this site without warning or liability arising from such action.

LIMITATION OF LIABILITY

Invision Gaming will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the Website. Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of Invision Gaming it’s employees or agents.

COPYRIGHT

All intellectual property of Invision Gaming such as trademarks, trade names, patents, registered designs and any other automatic intellectual property rights derived from the aesthetics or functionality of the Website remain the property of Invision Gaming. By using the Website you agree to respect the intellectual property rights of Invision Gaming and will refrain from copying, downloading, transmitting, reproducing, printing, or exploiting for commercial purpose any material contained within the Website.

DISCLAIMERS

The information is provided on the understanding that the website is not engaged in rendering advice and should not be wholly relied upon when making any related decision. The information contained with the Website is provided on an “as is” basis with no warranties expressed or otherwise implied relating to the accuracy, fitness for purpose, compatibility or security of any components of the Website. We do not guarantee uninterrupted availability of the www.invision-gaming.co.uk Website and cannot provide any representation that using the Website will be error free.

THIRD PARTIES

The Website may contain hyperlinks to websites operated by other parties. We do not control such websites and we take no responsibility for, and will not incur any liability in respect of, their content. Our inclusion of hyperlinks to such websites does not imply any endorsement of views, statements or information contained in such websites.

SEVERANCE

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.

GOVERNING LAW AND JURISDICTION

This Agreement will be governed by the laws of England and any user of the Website hereby agrees to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.

Privacy

• The information we collect is used to improve the content of our Web page, used to customize the content and/or layout of our page for each individual visitor.
• We use cookies to store visitors preferences, record session information, such as items that consumers add to their shopping cart, customize Web page content based on visitors' browser type or other information that the visitor sends.
• Persons who supply us with their telephone numbers on-line will only receive telephone contact from us with information regarding orders they have placed on-line.
• We do not partner with or have special relationships with any ad server companies.
• Upon request we provide site visitors with access to unique identifier information (e.g., customer number or password) that we maintain about them, contact information (e.g., name, address, phone number) that we maintain about them . Consumers can access this information by or By visiting their profile.
• We have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site.

User Agreement

By using the services provided by Invision Gaming you agree that you will abide and understand all of the following:

Definitions

The Site - Refers to the Invision Gaming site or any partner site of Invision Gaming

This is a LEGAL contract between YOU and Invision Gaming.

Section (1) User Conduct

As a user to the Invision Gaming network or any of its partner sites, you agree that you will strictly abide to the following and any variation from this wil result in a formal warning:

1. When communicating with a member of staff by written, verbal or any other means, you will conduct yourself with polite ettiquette and any offensive attitude whatsoever will result in a formal warning, service terminiation or legal action, but is not limited to any of these.
2. You will keep your account details safe and will not share it with anyone.
3. You will not try to exploit any of the services provided by Invision Gaming, such as the User Profiles, the Referral Scheme, the Ordering Cart and any other such services.
4. You will not maliciously or otherwise unintentionally damage any property of Invision Gaming's whether it be tangible or virtual.
5. You will not use Teamspeak to broadcast music or use it in any way other then general clan usage.
6. Your webspace provided by Invision Gaming should be used in a way that complies with all laws that govern United Kingdom and any content hosted must not be in violation with any copyright laws. Anything that falls outside this, will be immediately deleted without warning.
   
7. You will not use any abusive or discriminatory hostname for your server name.
8. You do not own more then one account unless you have written permission by Invision Gaming. If you are found ot own more then one account both accounts will be closed permenantly without remedy.
9. You will pay for your server before or coinciding with the 'Next Bill Date', failure to do so will result in the server being terminated and your game server IP may be lost.
10. You will not share any information with any other party other then yourself such as but not limited to, emails and correspondance between Invision Gaming staff and yourself.
11. Any libelous posts on Invision-Gaming's forums, newsgroups or any site that is accessible by the public will result in possible disciplinary action either regarding the services you rent or legal action being taken.
12. You may not advertise any company that is not partnered with the Invision Gaming company network on your servers.

Section (2) Service Restrictions

1. Bots are not allowed on any Invision Gaming server without written permission from a member of staff.
2. If you have a Private server it will remain locked at all times. If the password is removed you will receive a warning and your server will be automatically disabled. Second warnings will result in action being taken.
3. If you have a Branded server it will remain branded at all times. If the brand is removed you will receive a warning and the server will be automatically disabled. Second warnings will result in action being taken.

Section (3) Implied Terms

The following terms are implied in all User contracts and have effect at the time any person uses the site

1. There is an implied term that you have understood and agreed with all subject matter in this contract
2. It is understood that all correspondance sent by Invision Gaming shall have immediate effect, whether sent by mail, email, phone or any other means of communication.
3. It is implied that all your user information is up to date and accurate.

Section (4) Downtime or Outages

1. You understand that any downtime suffered to your server due to it being disabled for breach of contract, such as removing the branded text, changing slot sizes or any other breach, will not be reimbursed or compensated in any way.
2. The user accepts that downtime or outages may happen with our web site or gaming services which will result in the user not being able to access these services. The user accepts that any outage will not allow the user to have a claim for breach of contract if the downtime is of reasonable length. Your statutory rights provided by the Sale of Goods Act 1979 are not affected.
   
3. The user accepts that maintenance is an essential part of the upkeep of our servers and services and any downtime related to maintenance does not breach our contract.

Section (5) Refunds

1. Invision Gaming does not have a refund gaurentee nor do we operate in such a way that encompasses the right of any user to demand a refund on any basis that is not outlined by statutory provisions.
   
2. Sub Section 1 of this section may be set aside and a refund offered where it is Invision Gamings sole belief that such an action is required. The requirement for a refund will be judged reasonably under consideration of facts that the user relies on.
3. Where a refund is provided where Invision Gaming is not compelled by Statute to offer one, you may incur administration charges and costs that will be deducted from the refund.
4. In application of sub section 3 of this section, the 'charge' is calculated by taking in to account factors surrounding your orders as follows but are not limited to these:

• Support provided during your lease
• Setup costs incurred to process your orders
• Bandwidth used during your lease
• Charges we incur in processing any refund or from accepting your order initial payment
• A monthly pro-rata sum of your lease or order subscription

Section (6) Responsibilities

1. Invision Gaming will, to the best of our ability provide you with the services you have purchased.
   
2. The after sales support for game servers, does not include customisation of your server. Any customisation such as mod installations, MOTD, script building or anything considered customisation past the point of a default setup is not in Invision Gaming's contractual obligations.
   
3. All content (data,structure or information) on your home directory or storage for any services provided by Invision Gaming are to backed up by the customer to a remote location. In the event of loss of data for failure to effectively manage your data Invision Gaming will not be held liable.
   
4. You have a responsibility to pay any invoices or subscription costs punctually. Where you fail to do so, we will end your services without any warning and remove your services.
5. Invision Gaming have a responsibility to process your order/s in a reasonable time. When an order is received during normal business hours you will be activated that day where possible or appropriate. For the purposes of this section normal business hours are 7AM to 4PM Monday to Friday GMT. Any order received after 4PM will not be considered to have been placed on that day. Invision Gaming has the right to delay setup of any services, in the course of protecting our rights as a seller by investigating any possible fraudulent transaction. Where Invision Gaming is investigating a transaction we can freeze the set up time for up to 7 days after an order is received.
   

Section (7) Limited Liability

1. Invision Gaming will not be held responsible for any damages consequential and otherwise arising from the use of our services or network.

Section (8) Right to Refuse Service

1. Invision Gaming may refuse to accept any customer or website for participation of our services at its sole discretion, or for reasons which is neccessary to ensure the safety and continuation of Invision Gaming's staff, members, network, intellectual property or physical assets (but not limited to).

Section (9) Indemnifcation

1. The customer by agreeing to this agreement, agrees to indemnify Invision Gaming, its employees, agents and representatives harmless from any but not limited to, claims, demands, liabilities, expenses, actions, damages and legal fees that may arise from any court action or claims for libel, slander, copyright, trademark violation, personal damage, or other claims resulting from:
   
   1. customer participation in the Invision Gaming services hosting network
      
   2. operation of customers website, or any website on our network

Customer agrees to indemnify Invision Gaming for any legal fees incurred by Invision Gaming, in investigating or enforcing its rights under this agreement.

Section (10) Arbitration

1. The governing law over your contract with Invision Gaming is that of United Kingdon, London.
